California Privacy Protection Agency Board Votes to Take Positions on Three California Bills

SACRAMENTO, CA —Today, the California Privacy Protection Agency Board voted to support two California bills and took a “support if amended” position on a third bill. Collectively, these bills seek to strengthen privacy protections for Californians and make privacy rights more effective.
The Board voted to support the following bills:
- Assembly Bill 1542, introduced by Assemblymember Ward, which expands protections for sensitive data by prohibiting the sale and sharing of consumers’ sensitive personal information. If passed, this bill would allow California to keep pace with statessuch as Maryland that prohibit the sale of certain personal information.
- Senate Bill 1106, introduced by Senator Cabaldon, improves the deletion right under the Delete Act by requiring that data brokers process requests for deletion within 30 days instead of 45 days. If passed, the bill will ensure that consumer requests are promptly addressed.
In addition, the Board voted to take a “support if amended” position on Assembly Bill 883, introduced by Assemblymember Lowenthal. This bill provides elected officials and judges with an expedited process under the Delete Act to have their personal information deleted by data broker. While the bill seeks to address an important issue, CalPrivacy identified some issues with the bill as drafted. The Board voted to support the bill if it is amended to delay implementation, modify the agency’s role, and address privacy and security concerns, in order to make the bill more feasible and effective.
“CalPrivacy recognizes that privacy rights cannot be stagnant and our privacy laws need updates from time to time to address new harms and improve how rights are exercised,” said Maureen Mahoney, Deputy Director of Policy and Legislation. “We thank the authors for these important proposals and appreciate the Board’s thoughtful consideration of each.”
